2. In the present case, the petitioner seeks bail in connection with Khusrupur P.S. Case No. 500 of 2025 dated 15.12.2025, registered for the offences punishable under Sections 103(1) and 3(5) of the B.N.S., 2023.

3. As per the prosecution case, the sister of the informant was married with the petitioner ten years back. On 15.12.2025, the petitioner informed the informant that his sister had been quarreling with him and subsequently told him that she has committed suicide by hanging herself.

4. Learned counsel appearing on behalf of the petitioner submits that petitioner is innocent and he has falsely been implicated in the present case. The petitioner is the

No.31549 of 2026(3) dt.01-07-2026 2/3 husband of the deceased and on the fateful day the deceased picked up some quarrel with the petitioner and the petitioner also informed the brother of the deceased about the occurrence. The decease hanged herself in a fit of anger and committed suicide. The post-mortem report shows that there was no external injury except for the ligature mark on neck and there was no fracture of hyoid bone or thyroid cartilage which rules out homicidal strangulation. There was no motive or reason given for causing death of the sister of the informant by the petitioner or his family members. Learned counsel next submits that petitioner is having clean antecedent and chargesheet has been submitted. Learned counsel lastly submits that petitioner is in custody since 10.03.2026.

5. Learned A.P.P. appearing on behalf of the State as well as the learned counsel for the informant oppose the submissions made on behalf of the petitioner. Learned counsel for the informant submits that from the inquest report it appears that the ligature mark was all around the neck. Similarly, postmortem also talks about ligature mark around the circumference of the neck of the deceased and such ligature mark could not be caused in a case of suicide by hanging.

6. Having regard to the facts and circumstances and submissions made on behalf of the parties and considering the

No.31549 of 2026(3) dt.01-07-2026 3/3 doubtful and vague nature of allegation and further considering petitioner's clean antecedent and his period of custody and submission of chargesheet against him, the petitioner, abovenamed, is directed to be released on bail, on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class, Patna City / concerned Court, in connection with Khusrupur P.S. Case No. 500 of 2025, subject to the condition laid down under Section 480(3) of the B.N.S.S. and other following conditions:

(i) One of the bailors will be a close relative of the petitioner.

(ii) The petitioner will remain present on each and every date fixed by the court below, if so required by the learned trial Court.

(iii) In case of absence on three consecutive dates or in violation of the terms of the bail, the bail bond of the petitioner will be liable to be cancelled by the Court concerned. (Arun Kumar Jha, J) Shahnawaz/- U T
