In the light of statement made in the supplementary affidavit, counsel for the petitioner is permitted to make necessary correction in paragraph-3 of the main application in course of the day.

Heard learned counsel for the petitioner and learned APP for the State.

The petitioner seeks bail in a case registered under Section 307 of the Indian Penal Code and 27 of the Arms Act. The prosecution case in short is that on the occasion of marriage, people were talking at the door of the informant. All of a sudden, a cartridge was fired which hit the wall. One Chandradeep Yadav having Katta in his hand was fleeing.

No.30286 of 2019(3) dt.11-07-2019 2/2 It has been submitted on behalf of the petitioner that there is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is in custody since 26-03-2019. The petitioner is not named in the FIR. During investigation, in restatement of the informant, petitioner's name surfaced. Allegation of firing is against co-accused Chandradeep Yadav. None is said to have been injured in course of occurrence. On behalf of the State, it is submitted that the petitioner is not named in the Complaint Case/F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nawada in connection with Pakribarawan (Dhamaul) P.S. Case No. 122 of 2017.
