1. Heard the parties
2. The petitioners seek regular bail in connection with Sasaram (T) P. S. Case No. 914 of 2025 registered for the offences punishable under Sections 137(2) and 140(3) of the B.N.S., 2023 and later on Sections 105(1) and 238 of B.N.S. have been added.
3. The main submissions advanced by the petitioner's counsel are that the petitioners are innocent and have been falsely implicated in the present case and the petitioners are not named in the F.I.R. and their names surfaced only during investigation on the basis of suspicion and the fact that the deceased and the petitioners were close friends and had gone to Kolkata together for market purpose and while visiting the
Patna High Court CR. MISC. No.31950 of 2026(2) dt.12-05-2026 2/3 Kolkata Millennium Park, near the Ganga river the deceased accidentally slipped and fell into the river and despite efforts made by the petitioners and local persons to save him, he unfortunately drowned. It is further submitted that after recovery of the dead body, an unnatural death case was registered by Lal Bazar Police, Kolkata and postmortem examination was conducted, wherein the cause of death has been shown as ante mortem drowning and no external injury was found on the body of the deceased and there was neither any previous enmity nor any motive or mens rea on the part of the petitioners to commit the alleged occurrence and the petitioners have clean antecedent and have been languishing in jail since 18.03.2026.
4. Learned APP appearing for the State has opposed the bail prayer of the petitioners.

In the facts and circumstances of this case and considering the statements made in the petition as well as above submissions, coupled with the medical findings given in the postmortem report of the deceased regarding his cause of death and the petitioners have no criminal antecedent, this court is inclined to enlarge the petitioners on bail, accordingly, let the petitioners named-above be enlarged on bail in connection with
Patna High Court CR. MISC. No.31950 of 2026(2) dt.12-05-2026 3/3 Sasaram (T) P. S. Case No. 914 of 2025 on furnishing bail bonds of Rs. 20,000/- (Rupees Twenty Thousand) each with two sureties of the like amount each to the satisfaction of the Court concerned.
