====================================================== CORAM: HONOURABLE MR. JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 20-04-2022 Heard learned counsel for the petitioner and learned APP for the State.

Learned counsel for the petitioner is expected to honour his undertaking given in the instant case for depositing the requisite court fee and to remove the defects as pointed out by the office when called upon to do so by the office.

The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 406, 420, 409, 467, 468, 471, 34 of the Indian Penal Code.

The prosecution case as per F.I.R is that the

No.32765 of 2020(10) dt.20-04-2022 2/3 petitioner along with co-accused Vijay Kumar Thakur and Ram Chandra Chaudhary in collusion with each other committed defalcation of khadi cloths and other articles worth Rs. 50 lakhs kept in the godown of Khadi Bhandar Bhawan situated at Hajipur and they locked the godown on 24.11.2015, as a result of which, the furniture and other articles worth Rs. 5 lakhs got damaged. It is further alleged that a committee was constituted for conducting enquiry who submitted its report and found the allegation against the petitioner true. Accordingly, the petitioner has been dismissed from the post of Manager.

It is submitted by learned counsel for the petitioner that informant himself was an employee of the Khadi Bhandar who was discharged on 18.01.2017 due to misconduct.

It is submitted by learned counsel for the informant that anticipatory bail petition of co-accused Vijay Kumar Thakur has been rejected by a co-ordinate

Patna High Court CR. MISC. No.32765 of 2020(10) dt.20-04-2022 3/3 Bench of this Court vide order dated 03.12.2020 passed in Cr. Misc. No. 26471 of 2020.

Regard being had to the facts and circumstances of the case, this Court is not inclined to grant anticipatory bail to the petitioner. The prayer for grant of anticipatory bail to the petitioner is rejected. However, if the petitioner surrenders before learned Court below within a period of four weeks and pray for regular bail, the same shall be considered without being prejudiced by the order of this Court.
