2. The petitioner has prayed for regular bail in a case registered for the offence punishable under section 395 of the Indian Penal Code.
3. The case of the prosecution is that the petitioner and other being armed with weapons snatched Rs. 4500/- and a mobile. It has further been alleged that they also took away saree and golden ornaments.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in connection with the present case. It is further submitted the FIR was lodged against unknown miscreants. During course of
Patna High Court CR. MISC. No.30709 of 2025(2) dt.20-05-2025 2/2 investigation, one Bablu Paswan was arrested and he has named this petitioner in his confessional statement. It is further submitted that the said Babloo Paswan, in whose confessional statement name of the petitioner has surfaced, has been extended the privilege of bail vide order dated 22.12.2011 passed in Cr. Misc. No. 36905 of 2011. Moreover, the petitioner is languishing in judicial custody since 28.01.2025.
5. Learned APP appearing for the state has opposed the prayer of regular bail.
6. Considering the aforesaid facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Cheriya Bariyarpur P.S. Case No. 72 of 2011 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM, Manjhaul (Begusarai), subject to the condition that petitioner shall be present in the trial when ever required and shall not jump the privilege of bail.
