The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 341, 323, 307, 504/34 and 302 of the Indian Penal Code. Allegation of commission of death of Pawan Kumar is against co-accused, Jugo Mandal.
Submission is that similarly situated co-accused, Bulaki Mandal has already been allowed bail by a co-ordinate Bench of this Court passed in Criminal Miscellaneous No.58676 of 2018, considering the fact that no serious injury was found on the person of the informant or her husband to whom Bulaki
Patna High Court Cr.Misc. No.61448 of 2018(2) dt.19-11-2018 2/2 Mandal and others, including the petitioners had assaulted. In view of the aforesaid facts, let the petitioners, above named, in the event of their arrest or surrender before the court below within a period of thirty days from the date of receipt of the order be released on bail on furnishing bail bonds of Rs.20,000/- (Rupees Twenty Thousand) each with two sureties of the like amount each to the satisfaction of learned court below where the case is pending in connection with Jagdishpur Police Station Case No.297 of 2018, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure as well as condition that the petitioners shall fully co-operate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bonds of the petitioners.
