The petitioner is an accused in connection with Amdabad P.S. Case No. 208 of 2020 under Sections 302, 120(B)/34 of the Indian Penal Code and Section 27 of the Arms Act lodged on 24.10.2020 by the informant, Phagu Choudhary. As per the FIR, the informant has alleged that it is the petitioner, who opened fire from the back which hit his father and the bullet went out of the body through the stomach. He was immediately taken to the Primary Health Centre, Amdabad and from where was referred to Katihar Medical College but he succumbed to the injury.

Earlier the prayer for bail of the petitioner was dismissed on merit vide order dated 12.08.2022 passed in Cr.

Patna High Court CR. MISC. No.32987 of 2023(2) dt.21-06-2023 2/2 Misc. No. 26308 of 2022.

Considering the specific allegation that has come against the petitioner of killing the informant's father causing his death, this Court is not inclined to grant him privilege of bail which is accordingly rejected.

However, the Trial Court is directed to conclude the the trial within a period of nine months from today. (Rajiv Roy, J) Jagdish/KiranU T
