JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 21-02-2022 Heard learned counsel for the petitioner and the State. Petitioner seeks regular bail in a case registered for the offence punishable under Section 376 and some other allied Sections of the Indian Penal Code.

As per the prosecution case, this petitioner is alleged to have subjected the victim to repeated sexual intercourse on the false promise of marriage resulting in pregnancy. Learned counsel appearing for the petitioner submits that petitioner is innocent and has falsely been implicated in the case. The victim is major and she is residing in live-in relation with petitioner and when petitioner could not solemnize marriage with her she lodged this false and concocted case. It is further submitted that victim is major and knowing the consequences fully well she established physical relation with

Learned counsel appearing for the State opposes the prayer for bail.

Considering the fact that investigation is complete and period of custody, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-IV, Munger in connection with Kharagpur PS case No. 351/2017.
