2. This is an application for regular bail on behalf of the petitioners for the offences alleged under Sections 302/34 of the Indian Penal Code and Section 27 of the Arms Act, in connection with Panchrukhi P.S. Case No. 198 of 2023.
3. As per prosecution case, some unknown miscreants have killed the brother of the informant by gun-shot.
4. The learned counsel for the petitioners has
Patna High Court CR. MISC. No.36701 of 2024(4) dt.19-09-2024 2/3 submitted that they have been falsely implicated in this case and have committed no offence. Petitioners are not named in the FIR rather the same has been lodged against unknown person. There is no specific overt act against these petitioners and no eyewitness of the alleged occurrence, save and except confession, nothing has come against these petitioners. He further submitted that on the basis of confessional statement of co-accused Sonu Kumar Singh, one black bag was recovered from the room of the petitioner no. 1, but the same was not put on T.I.P and the co-accused Sonu Kumar Singh has already been granted bail by learned Court below itself vide B.P. No. 1007 of 2023. No incriminating article has been recovered from the conscious possession of the petitioners. Moreover, petitioners are in custody since 27.01.2024.
5. Learned APP for the State has opposed the prayer of bail.
6. Considering the above facts and circumstances of the case, let the petitioners, above-named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned J.M. 1st Class, Siwan in connection with Panchrukhi P.S. Case No. 198 of 2023, subject to the condition that the
