Case No. 107 of 2016 which has been instituted for the offences under Sections 363(A), 364, 365 of the Indian Penal Code on the ground that the victim boy has been recovered and has also given his statement disputing the allegations in the F.I.R. These matters would be looked into by the Investigating Agency and a report shall be filed
Patna High Court CR. MISC. No.39182 of 2019(2) dt.04-07-2019 2/2 promptly. Recovery of an abducted boy cannot be the basis for seeking quashing of the F.I.R.
The petition stands dismissed.
However, it is observed that the investigation be concluded as expeditiously as possible, preferably within a period of three months.
