JUSTICE VINOD KUMAR SINHA ORAL ORDER 17-07-2019 This application, for grant of anticipatory bail, arises out of Bahadupur P.S. Case No. 318 of 2018, disclosing offences under Sections 498A, 379 and 34 of the Indian Penal Code.
Petitioner happens to be husband of the informant and allegation against him of demand of dowry and subjecting the informant to torture for non fulfillment of the demand. Submission of learned counsel for the petitioner is that he is still ready to keep the informant with full honour and dignity and allegations are false and concocted. Heard learned A.P.P. as well as learned counsel for the informant. Learned counsel for the informant opposed the prayer for bail and submitted that in the court below also the petitioner has taken such plea and when he was directed by the
Patna High Court CR. MISC. No.29524 of 2019(3) dt.17-07-2019 2/2 court below to take the informant with himself, he refused to take the informant with him.
Having heard both sides, considering the facts and circumstances and the conduct of the petitioner, I am not inclined to grant the privilege of anticipatory bail to the petitioner. However, if the petitioner is ready to keep the informant he would go to the informant and persuade her for living with him and appear before the court below while filing regular bail petition, which will be considered by the court below considering such fact and to dispose of the prayer for regular bail of the petitioner, if possible, on same day. With the above observation and direction this application is disposed of.
