JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 24-07-2023 At the outset, learned counsel for the petitioner No. 2 seeks permission to withdraw the pre-arrest bail petition. This bail petition of petitioner No. 2 is dismissed as withdrawn.

Heard learned counsel for the petitioner No.1 and the State.

2. Petitioner apprehends arrest in a case registered for the offence punishable under sections 323, 341, 379, 504, 506/34 of the Indian Penal Code.

3. As per the prosecution case, all the F.I.R named accused persons including this petitioner armed with lathi, danda assaulted the informant and his family members in which

4. It is submitted that both the parties are neighbor and due to pending land dispute, a simple occurrence of maarpeet took place between them. Specific allegation of assault is against other co-accused persons. Case and counter case. Petitioner claims clean antecedent.

5. Learned counsel for the State opposes the bail petition of the petitioner.

6. Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within six weeks from today, let the petitioner No. 1 , as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of Learned J.M.-1 Class, Begusarai in connection with Matihani P.S. case no 186 of 2022, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
