JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 20-01-2021 Heard learned counsel for the petitioners and learned Additional Public Prosecutor appearing on behalf of the State. The petitioners are apprehending arrest in connection with Goraul (Katahara O.P.) P.S. Case No. 312 of 2019 for offences under Sections 147, 149, 333, 337, 338, 341, 323, 353, 307, 427, 504, 506 and 120(B) of the Indian Penal Code. Learned counsel for the petitioners submits that the petitioners have no criminal antecedents.

It is alleged that the the petitioners were among the people, who assembled and ransacked the police station. Learned counsel appearing on behalf of the petitioners submits that other accused persons, namely, Ranjeet Sharma and

Patna High Court CR. MISC. No.31163 of 2020(2) dt.20-01-2021 2/2 Mithilesh Kumar have been granted anticipatory bail by a coordinate Bench of this Court vide order dated 17.12.2020 passed in Cr. Misc. No. 30364 of 2020.

Considering the fact that the petitioners have no criminal antecedents, the Court is inclined to grant the privilege of anticipatory bail to the petitioners subject to the condition that the petitioners have to deposit Rs.25,000/- in cash. On depositing the amount of Rs.25,000/-, petitioners, above-named, in the event of arrest or surrender within one month from today, shall be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-1, Vaishali at Hajipur in connection with Goraul (Katahara O.P.) P.S. Case No.312 of 2019, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. Deposit of Rs.25,000/- (Rupees twenty five thousand) shall abide by final outcome of Goraul (Katahara O.P.) P.S. Case No. 312 of 2019.
