The petitioner seeks bail in Gardanibagh P.S. Case No. 153 of 2021 corresponding to Special (POCSO) Case No. 53 of 2021, registered for the offence punishable under Sections 354(A), 354(D) and 506 of the Indian Penal Code and section 8/12 of the POCSO Act.

As per the prosecution case, on 15.01.2021 petitioner entered in the house of informant (minor) and molested her. It is further alleged that this petitioner for the last two years committing misbehaviour with the informant.

It is submitted on behalf of petitioner that from the FIR itself, it is apparent that petitioner was driver of the vehicle of the informant and there was money dispute between the parties, as a result of which this petitioner has been falsely

Patna High Court CR. MISC. No.41984 of 2021(2) dt.26-10-2021 2/2 implicated in this case. Moreover, the occurrence took place on 15.01.2021, but the FIR was lodged on 10.04.2021 after delay of three months, for which there is no plausible explanation. Petitioner is in custody since 10.04.2021. Chargesheet has already been submitted. Investigation is complete. Considering the period of custody and nature of allegation, the petitioner above-named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge VI-cumSpecial Judge POCSO Act, Patna in connection with Gardanibagh P.S. Case No. 153 of 2021 corresponding to Special (POCSO) Case No. 53 of 2021.
