Patna High Court CWJC No.8272 of 2017(4) dt.19-05-2020 2/3 encashment, arrears of salary, Group Insurance and General Provident Fund with statutory interest thereon as the petitioner has already retired from the post of peon from the office of the Executive Engineer, Sone Canal Division, Buxar. From perusal of the counter affidavits, it appears that the petitioner has already been paid her all retiral benefits. The Pension Authority Slip was also issued on 20th July, 2016. Since the petitioner has not vacated her official quarter, therefore, No Dues Certificate was not issued. The case was also placed before the Lok Adalat but the matter could not settled. Again the case was listed on 08.05.2019 but on that day none appeared on behalf of the petitioner.

It appears that the petitioner has already been paid her all retiral dues and her pension has also been fixed, therefore, the writ petition, in my view, has become infructuous. Accordingly, the writ petition is dismissed.

If the petitioner has got any grievance, the petitioner may represent before the authority and on such representation having been filed by the petitioner, the authority shall consider and dispose of the same by a reasoned order within three months from the date of filing of such representation.
