The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 304, 306/34 of the Indian Penal Code and Section 3⁄4 of Dowry Prohibition Act It is a case of abatement for suicide due to assaulting and abusing on non fulfillment of dowry demand. It is submitted by learned counsel for the petitioners that petitioners are innocent and they have
Patna High Court CR. MISC. No.31182 of 2022(2) dt.16-11-2022 2/2 falsely been implicated in the present case. It is further submitted that petitioners are in-laws of the deceased and they have no concern with the mess and business of the deceased and her husband. It is apparent from the F.I.R. that the deceased along with her husband and children was residing separately on rent. It is also submitted that deceased herself has committed suicide.
In the facts and circumstance of the case, let the petitioners, above named, in the event of their arrest or surrender before the Court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/-(Ten Thousands) each with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Siwan in connection with Basantpur P.S. Case No. 236 of 2021, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
