JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 30-06-2022 Heard learned counsel for the petitioner and the State. Petitioner apprehends his arrest in a case registered for the offence punishable under Section 379 of the Indian Penal Code.

Petitioner has been made accused in this case on the basis of confessional statement of co-accused. Learned counsel appearing for the petitioner submits that petitioner is innocent and has falsely been implicated in the case. No stolen article has been recovered from the conscious possession of the petitioner and confessional statement of coaccused has got no evidentiary value. Learned counsel appearing for the State opposes the prayer for anticipatory bail and submits that petitioner has got criminal antecedent of similar nature.
