JUSTICE VINOD KUMAR SINHA ORAL ORDER 01-08-2019 This is an application for grant of anticipatory bail in connection with Danapur P.S. Case No. 804 of 2018, disclosing offences under Sections 414 and 34 of the Indian Penal Code and Section 7 of the Essential Commodities Act, 1955. Allegation as per F.I.R. is that on the raid of godown of the petitioner, huge quantity of rice was recovered kept there and those rice were of the Food Corporation of India. Submission of the learned counsel for the petitioner is that the whole allegation is false and concocted. Moreover, the owner of the godown has moved before this Court in C.W.J.C. No. 1512 of 2019 for release of the seizure articles and the same was directed to be released, vide order dated 01.02.2019. Heard learned A.P.P. also.

Having heard both sides, considering the above submission, this application is allowed. Let the petitioner,

Patna High Court CR. MISC. No.32724 of 2019(2) dt.01-08-2019 2/2 above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned Aditional Chief Judicial Magistrate-I, Danapur, Patna, in connection with Danapur P.S. Case No. 804 of 2018, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure with condition that he has to co-operate in the investigation.
