JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 14-12-2022 Heard learned counsel for the petitioner and learned APP for the State and perused the case diary. The petitioner is apprehending his arrest in a case registered for the offence punishable under Sections 363 and 366 of the Indian Penal Code.

Allegedly, it is a case of abduction of the wife of the informant and making sexual relation with her by this petitioner. It is submitted by learned counsel for the petitioner that the petitioner has falsely been implicated in this case. He further submits that the victim is major and matured lady and she went herself on her own sweet-will with this petitioner and there is inordinate delay in lodging the FIR. Petitioner has got clean antecedent.

Learned APP appearing for the State has opposed the

Patna High Court CR. MISC. No.31888 of 2022(3) dt.14-12-2022 2/2 prayer for anticipatory bail of the petitioner and submitted that the victim was recovered and her statement was recorded under Section 164 of the Cr.P.C. which is mentioned in para-40 of the case diary wherein she stated about the complicity of the petitioner and also stated he made sexual relation with her forcefully.

After considering the aforesaid facts and circumstances of the case, I am not inclined to grant anticipatory bail to the petitioner.

Prayer for anticipatory of the petitioner is rejected. However, the petitioner is directed to surrender before the court below and pray for regular bail. (Sunil Kumar Panwar, J) Brajesh Kumar/- U T
