None ====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 05-10-2023 Heard learned counsel for the petitioner and learned State counsel. Despite valid service of notice, nobody appears on behalf of private respondents.

2. This writ application has been filed for quashing of order dated 16.05.2013 passed by learned Commissioner, Magadh Division Gaya / Respondent no. 2 in Land Disputes Resolution Appeal No. 97 of 2013, by which, the learned Commissioner dismissed the appeal filed by the petitioner under Section 14 of Bihar Land Disputes Resolution Act, 2009 as well as quashing of order dated 23.01.2013 passed by respondent no. 3/L.R.D.C. Aurangabad in Land Dispute Case No. 103 of 2012.

3. Learned State counsel submits that in view of proviso to Section 15 of the Bihar Land Tribunal Act, 2009 this matter can well be adjudicated by the Bihar Land Tribunal.

4. Accordingly, learned counsel for the petitioner requests for disposal of this writ application granting liberty to the petitioner to move before the Bihar Land Tribunal for proper adjudication of the matter.

5. In view of the aforesaid submission, let the petitioner file afresh application before the Bihar Land Tribunal

Patna High Court CWJC No.19443 of 2013(4) dt.05-10-2023 3/3 for adjudication of the matter, within a period of four weeks from the date of receipt / production of copy of this order.

6. The writ application stands disposed of with the aforesaid direction.
