Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks regular bail in connection with N.D.P.S. Case No. 98 of 2021 arising out of Ahiyapur P.S. Case No. 478 of 2021 lodged under Sections 399, 402/34 of the I.P.C. read with Sections 25(1-b)a, 26, 35 of the Arms Act and Sections 8/20(b)(ii)(B) of the N.D.P.S Act.

As per the prosecution case, the recovery of 1 desi katta, 1 live cartridge and 1⁄2 kg of Charas has been made, which is the subject matter of the present case.

Learned counsel for the petitioner submits that there are 2 criminal case pending against the petitioner in which he is on bail. Counsel submits that petitioner is in custody since

Patna High Court CR. MISC. No.31359 of 2022(4) dt.06-12-2022 2/2 21.07.2021 and charge sheet has already been filed in this case. Learned counsel for the State opposes the prayer for bail and submits that this is not the first N.D.P.S. case rather the antecedent is also related to N.D.P.S. case.

In the present facts and circumstances of this case and the submissions made above, I am not inclined to grant bail to the petitioner, therefore, his bail petition is hereby rejected. With this observation, the bail application stands rejected.
