Petitioners filed this petition for initiation of contempt proceeding against the opposite parties for disobeying the order

Patna High Court MJC No.4177 of 2013(12) dt.13-02-2020 2/2 dated 11.01.2013 passed in C.W.J.C. No.282 of 2013. Learned counsel for the petitioners submits that this court by order dated 11.01.2013 directed the respondents to issue appointment letters to the petitioners subject to there being no other legal bar to the issuance of the same. It is further submitted that from perusal of waiting list, it would appear that the name of petitioner no.1 figured at serial no.152 but Geeta Kumari, whose name figured at serial no.200, has been appointed but it appears that Geeta Kumari got 74.33% marks whereas petitioner no.1 Sunita Kumari got 51% marks. The petitioners have not been able to show that the person, who got less marks than petitioner no.1, has been appointed from the waiting list.

Having considered the facts, I do not find any merit in this contempt petition. Accordingly, the same is dismissed. If the petitioners are aggrieved by appointment of any person, the petitioners may file fresh writ petition in accordance with law.
