28-09-2018 Heard Sri Manoj Kumar, learned counsel for the petitioners. None appeared on behalf of State. Three petitioners, apprehending their arrest in Complaint Case No. 1597 of 2017 registered for offence under Section 406 of the Indian Penal Code and Section 3 of the Dowry Prohibition Act, 1961, have prayed for grant of bail in the event of their arrest or surrender.
Learned counsel for the petitioners submits that petitioner no. 2 is the own brother of the complainant and in a nature of civil dispute, the complainant has alleged, as if, it was a case of commission of criminal offence.
Patna High Court Cr.Misc. No.60174 of 2018(2) dt.28-09-2018 2/2 Besides hearing learned counsel for the petitioners, I have also perused the material on record, particularly the complaint petition.
Considering the nature of accusation as well as the fact that petitioner no. 2 is the own brother of the complainant, in the event of arrest or surrender within a period of six weeks from today, let aforesaid three petitioners namely 1. Gulnaj Begum, 2. Abdul Quayum Master @ Abdul Quayyum and 3. Md. Sahid be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Begusarai in connection with Complaint Case No. 1597(C) of 2017, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure, 1973.
