The petitioner seeks bail in connection with Jalalpur P.S. Case No. 144 of 2020 for the offence under Sections 30(a) of the Bihar Prohibition and Excise Act. Learned counsel appearing for the petitioner submits that the petitioner, who is of clean antecedent, is innocent and has not committed any offence. Nothing has been recovered from the conscious possession of the petitioner and the petitioner has no concern with the alleged recovery. The petitioner is rotting in judicial custody since 13.08.2020.

Considering the facts and circumstances of the

Patna High Court CR. MISC. No.31020 of 2020(2) dt.22-12-2020 2/2 case, let the, above named, petitioner be released on bail on furnishing his personal bond to the satisfaction of learned 2nd Additional Sessions Judge -cum-Special Judge, Excise, Saran at Chapra in connection with Jalalpur P.S. Case No. 144 of 2020.
