ANJANA MISHRA ORAL ORDER 08-10-2018 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.

The petitioners apprehend their arrest in connection with Alauli P.S. Case No. 09/2017, registered for the offences punishable under Sections 341/323/307/504/506/354/34 of the Indian Penal Code.

Learned counsel for the petitioners submits that though it is alleged that these petitioners attacked the said Arvind Singh, elder brother-in-law of the informant with lathi, rod, leg and fists yet the injury which is said to be on the person of the said Arvind Singh has been found to be only a single injury. It is submitted that on account of previous case lodged by one Ankesh

Patna High Court Cr.Misc. No.62349 of 2018 (2) dt.08-10-2018 2/2 Yadav bearing Alauli P.S. Case No. 08/2017 these petitioners have been falsely implicated in connection with the present case. Considering the aforementioned facts and circumstances and that there is previous enmity between the parties and no specific role can be attributed to either or any of the present petitioners, let the petitioners abovenamed in the event of their arrest / surrender within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the each amount to the satisfaction of the learned Chief Judicial Magistrate, Khagaria, in connection with Alauli P.S. Case No. 09/2017, subject to the conditions as laid down under Section 438(2) of the Cr. P.C. (Anjana Mishra, J) Saif/- U T
