Petitioner apprehends arrest in a case registered for the offence punishable under Sections 498(A), 304(B) and 120(B) of Indian Penal Code.

As per prosecution case, petitioner along with other FIR named persons tortured and killed daughter of the informant due to non-fullfilment of demand of dowry. Learned counsel appearing for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. It is submitted that allegation is against husband of the deceased who is already in custody. Petitioner is mother-in-law, aged about 67 years, separate in mess and property and has got no concern with affairs of the married couple. Petitioner has got

Learned counsel for the informant vehemently opposes the prayer for bail application submitting that petitioner is named in the FIR.

Considering the aforesaid facts and circumstances, let the above named petitioner in the event of her arrest/surrender before the court below within a period of thirty days from the date of receipt/production of copy of this order, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Madhubani in Kaluahi P. S. Case No. 23 of 2022, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
