2. The petitioner is in custody in connection with N.D.P.S P.S. Case No. 28 of 2020 arising out of N.C.B. No. 12 of 2020 for the offence punishable under sections 20(b)(ii)©, 25, 26, 29, 35 and 60 of the N.D.P.S Act lodged on 13.10.2020 by the informant, ....
3. Earlier, the bail application was heard and rejected vide Cr. Misc. No. 66530 of 2021 and Cr. Misc. No. 46070 of 2023.
4. A report was called for from the concerned Court and the report dated 11.07.2024 issued by the learned Additional
Patna High Court CR. MISC. No.34536 of 2024(3) dt.23-08-2024 2/2 District and Sessions Judge 11, Bhagalpur shows that charges have been framed in 15.05.2022 against three accused persons and one witness has been examined and request has been made to produce the witnesses. Mrs. Shaila Kumari, learned counsel for the Central Government Counsel submits that she will ensure that the learned Special P.P. N.D.P.S. takes immediate step so that the trial is taken to its inimical conclusion and opposes the prayer for bail submitting that huge quantity of 370 kg 'ganja' has been recovered/seized.
Considering the allegation that has come against the petitioner, his bail application is rejected. However, having rejected the prayer, this Court has to look into the delay in conclusion of the trial and directs the concerned Trial Court to ensure that the trial is concluded at an earliest since the petitioner has remained in custody for last two weeks.
