JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 29-10-2021 Heard learned counsel for the petitioner and the State. The petitioner seeks regular bail in connection with N.D.P.S. Case No. 10/2018, registered for offences punishable under Section 20b of the Narcotic Drugs and Psychotropic Substance Act, 1985.
Allegation is of recovery of 13 kilo and 200 grams of ganja from the premises of the petitioner and two other accused persons.
It has been submitted on behalf of the petitioner that he has falsely been implicated in this case and in fact nothing has been recovered from the conscious possession of the petitioner. Moreover, the recovered quantity is less than the
Patna High Court CR. MISC. No. 43227 of 2021(2) dt.29-10-2021 2/2 commercial quantity and he has been in judicial custody since 30.5.202018. Similarly situated co-accused have already been allowed bail by a co-ordinate bench of this Court vide order dated 28.9.2018, passed in Cr.Misc.No. 57898/2018.
Learned counsel appearing for the State opposes the prayer for bail.
Considering the rival submissions of the parties, materials available on the record and the period of custody of the petitioner, prayer for bail of the petitioner is allowed. Let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the Special Judge, N.D.P.S.Act, in NDPS Case No. 10 of 2018.
