2. The petitioner apprehends arrest in connection with Madhepura P.S. Case No. 599 of 2024, registered under Sections 341, 323, 307, 324 and 34 of the Indian Penal Code.
3. The prosecution case, in short, is that, the petitioner and other co-accused persons variously armed came and asked the informant not to fill soil over the land. When the informant protested, co-accsued, namely, Chhotu Kumar assaulted the brother of the informant with spade causing injury on his head.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the
Patna High Court CR. MISC. No.32583 of 2025(3) dt.16-05-2025 2/3 present case. Learned counsel for the petitioner also submits that there is no allegation of any overt act against the petitioner. As per FIR, the allegation levelled against the petitioner is that he is the order giver of the said occurrence and on his order, coaccused, namely, Chhotu Kumar assaulted with spade causing cut injury on the head of Mukesh Kumar. It is further submitted that Charge-sheet has been submitted against other co-accused persons except this petitioner, but cognizance has been taken against the petitioner by the learned Court below, despite the fact that he was not sent up for trial. The petitioner has got four criminal antecedents in which he is on bail in three cases.
5. Learned APP for the State and learned counsel for the informant have vehemently opposed the prayer for grant of bail to the petitioner.
6. Considering the aforesaid facts and circumstances, let the petitioner, above named in the event of arrest/surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Court below/concerned Court in connection with Madhepura P.S. Case No. 599 of 2024 subject to the conditions as laid down under
