====================================================== CORAM: HONOURABLE MR. JUSTICE CHANDRA PRAKASH SINGH ORAL ORDER 08-12-2025 Heard learned counsel for the petitioner and learned A.P.P for the State.
2. The petitioner has preferred this application for grant of regular bail in connection with Session Trial No. 814 of 2024 arising out of Konch P.S. Case No. 256 of 2024 dated 14.06.2024 registered for the offences punishable under Section 302 read with Section 34 of the Indian Penal Code.
3. As per the prosecution case, unknown miscreants are alleged to have shot the informant's brother dead when he was sleeping at Dalan.
4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. The petitioner is not named in the F.I.R., and his name

No.35054 of 2025(3) dt.08-12-2025 2/3 has sprung up in the present case only on the basis of the confessional statement of the co-accused which has got no evidentiary value in the eyes of law. It is further submitted that except the confessional statement of the co-accused, there is no other substantive evidence to suggest the implication of the petitioner in the present case. Nothing has been recovered from the conscious possession of the petitioner. There is general and omnibus allegation against the petitioner. The petitioner has no concern with the alleged offence. It is further submitted that the other co-accused person, namely, Alakhdev Yadav @ Alakh Yadav, has already been granted bail in Cr. Misc. No. 12196 of 2025 vide order dated 14.05.2025 by a Bench of this Court. The petitioner has eleven (11) criminal antecedents as stated in para 3 of the bail petition. The petitioner is in custody since 19.06.2024.
5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.

Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner above named, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Additional
Patna High Court CR. MISC. No.35054 of 2025(3) dt.08-12-2025 3/3 Sessions Judge-XVIII, Gaya in connection with Sessions Trial No. 814 of 2024 arising out of Konch P.S. Case No. 256 of 2024 with further conditions:- (I) The petitioner is directed to remain physically present before the learned court below on each and every date, failing which on two consecutive dates without reasonable cause, the bail bond of the petitioner is liable to be cancelled.
(II) If the petitioner is found involved in any other criminal case in future, his bail bond is liable to be cancelled.
