25-10-2021 Heard learned counsel for the parties.

The petitioner seeks bail in Barhariya P.S. Case No. 254 of 2019, registered for the offence under Section 272, 273, 308 of the Indian Penal Code and Section 30(a), 41(i) of Bihar Prohibition and Excise Act.

132 liters & 840 ml. of foreign liquor has been recovered from a bamboo clamp, situated behind the house of the petitioner.

It is submitted on behalf of petitioner that nothing has been recovered from the conscious possession of the petitioner. The recovery has been made from a public place. Petitioner is in custody since 13.06.2021.

Learned A.P.P. for the State has opposed the bail petition.

Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Addl. Sessions Judge II cum Special Judge Excise, Siwan in connection with Barhariya P.S. Case No. 254 of 2019.
