The petitioner is in judicial custody in connection with S.Tr. No. 1338 of 2022 arising out of Punpun P.S. Case No. 231 of 2022 registered under Sections 302, 201 and 120(B) of the Indian Penal Code and Section 27 of the Arms Act lodged on 05.07.2022 by the informant, Jitendra Kumar.
As per the prosecution story, the allegation is that younger brother along with his friend had gone to the house of the petitioner relating to payment of dues of Rs. 1,50,000/- for which an agreement was executed but the amount was not returned.

No.33481 of 2023(3) dt.24-08-2023 2/3 Further, the informant later along with the villagers went to the house of Pintu Kumar but neither could found the brother nor the Pintu Kumar gave the correct picture rather he tried to misguide him. He as such suspected the abduction of his brother which followed the FIR.
Later, a dead body was found in the husk godown of the petitioner. The body was cut into pieces. Accordingly, the petitioner came into judicial net.
In this case, case diary was called for and learned APP for the State has drawn the attention to paragraph-19 of the case diary in which Jitendra Kumar @ Chunna and Manish Kumar gave the details that the said brother of the informant was cut into pieces and kept inside the husk of the petitioner's house.
In view of the fact that has come in the investigation, the reason being demand of Rs. 1,50,000/- by the deceased and the recovery of the body from his house, this Court is not inclined to grant any relief to the petitioner, which is accordingly rejected.
