2. The petitioner seeks bail in a case registered for the offences punishable under Section 317 (5) of the B.N.S. and Section 25 (1-b)a, 26 and 35 of the Arms Act.
3. The allegation in the first information report is that two motorcycle riders on motorcycle, having no registration number, took out the country made pistol and were waving the same in the air and after seeing the police force both tried to escape. However, one of the persons was caught on spot and on search one country made pistol was recovered from his physical possession.
4. It is submitted by learned counsel for the petitioner that the petitioner has been made accused in this case
Patna High Court CR. MISC. No.32310 of 2025(2) dt.19-05-2025 2/2 merely on suspicion. From perusal of the F.I.R., it would appear that the pistol was recovered from him but there is no allegation of using the pistol or making any gun shot or causing injury to any person. The petitioner has two criminal antecedents but they are not of the same nature and he is on bail in one of the cases. Petitioner has been languishing in custody since 17.03.2025.
5. Learned APP for the State opposed the bail petition.

Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned Court below where the case is pending/successor Court in connection with Civil Lines P.S. Case No.112 of 2025. (Soni Shrivastava, J) Trivedi/- U T
