Mr.Shailendra Kumar ====================================================== CORAM: HONOURABLE MR. JUSTICE VINOD KUMAR SINHA ORAL ORDER 20-05-2019 Petitioner seeks bail in connection with Rasulpur P.S. Case No. 132 of 2018 registered for the offences punishable under Sections 395 and 397 of the Indian Penal Code. Allegation as per FIR is that 4-5 miscreants entered into the shop of the informant and at the point of knife they looted silver and golden ornaments and also taken away PAN card, Aadhar Card, Identity card and mobile and petitioner is not named in the FIR.

Submission of learned counsel for the petitioner is that he has been named in this case on the basis of confession made by co-accused and though he is accused in two other cases but he is on bail in those cases and co-accused Naushad Ali has been granted bail by a co-ordinate Bench of this Court vide

Patna High Court CR. MISC. No.33091 of 2019(2) dt.20-05-2019 2/2 order dated 6.5.2019 passed in Cr.Misc.No. 28772 of 2019. Heard learned APP also.

In view of above facts and circumstances, let petitioner, named above, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-X, Saran at Chapra, in connection with Rasulpur P.S.Case No. 132 of 2018, subject to the condition that one of the bailors of the petitioner shall be a local person having sufficient immoveable property within the jurisdiction of the court concerned.
