====================================================== CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 15-01-2021 Heard learned counsel for the petitioner and the State.
The petitioner is in connection with S.Tr. No. 226 of 2019 arising out of Manpur P.S. Case No. 5 of 2019 (G.R. No. 141/2019) for the offences under Section 302 IPC and 27 of the Arms Act.
Having regard to the materials available on record including the case diary, the Court is not inclined to grant bail to the petitioner. The prayer is rejected.
However, the court below is directed to expedite the trial and conclude the same expeditiously preferably within a period of nine months from the date of receipt/production of a copy of this order.
The Superintendent of Police, Nalanda is directed to
Patna High Court CR. MISC. No.30640 of 2020(3) dt.15-01-2021 2/2 ensure examination of all the prosecution witnesses at the earliest so that the trial may be concluded within the time frame indicated above.
If the trial is not concluded within the same time, the petitioner shall be at liberty to renew his prayer for bail after nine months.
