The present application has been filed for restoration of Cr. Misc. No. 1223 of 2018 which stood dismissed for non-prosecution vide order dated 29.08.2018. It appears that vide Criminal Miscellaneous No. 44948 of 2012, the Opposite Party No. 2 was granted bail vide order dated 09.04.2013 in connection with Darounda P.S. Case 124 of 2012 registered for the offences punishable under Sections 307, 323, 328, 341, 494/34 and 498A of the I.P.C. This Court vide order dated 16.05.2018 passed in Criminal Miscellaneous No. 44948 of 2012 directed the petitioner for issuance of notice to Opposite Party No.2, in the present proceeding, but the requisites were not submitted, as a result,

Patna High Court Cr.Misc. No.65284 of 2018(2) dt.31-10-2018 2/2 the whole application got dismissed vide order dated 29.08.2018.

On the grounds mentioned in the restoration application, let Cr. Misc. No. 1223 of 2018 be restored to its original file, subject to submission of requisites in view of order dated 16.05.2018, within a period of one week. Accordingly, the restoration application is disposed of.
