The petitioner apprehends his arrest in a case registered for the offence under Sections 407, 409, 420, 120(B) of the Indian Penal Code.
The allegation against this petitioner, as per the F.I.R., is that the petitioner, who at the relevant time, was posted as incharge of Godown Manager at Supaul and during the period from 2017-18 and 2018-19, he has misappropriated the government money to the tune of Rs. 64,72,528/-. It is submitted on behalf of petitioner that the allegation, as made in the F.I.R., is out-and-out false and fabricated. Petitioner has never misappropriated any money, rather his senior officials in connivance with others committed

No.43455 of 2021(4) dt.28-06-2022 2/2 some irregularities and to this effect, the petitioner sent several letters to M.D., BISCOMAUN for making inquiry and taking appropriate action against the erring officials, but despite repeated requests, no action was taken by the BISCOMAUN. It is further submitted that some of the co-accused persons have already been granted regular bail by this Court. However, learned counsel for the informant / BISCOMAUN vehemently opposed the prayer for bail of petitioner and submitted that huge government money has been misappropriated by this petitioner, as incharge Godown Manager during his tenure.
Considering the aforesaid facts and circumstances as well as nature of allegation, the prayer for anticipatory bail of petitioner is rejected.
