JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 25-08-2022 Learned counsel for the petitioner is permitted to remove all the defects as pointed out by the Stamp Reporter. This writ application has been filed for the following reliefs:- "(i) For directing and commanding the respondent authorities to speedy investigation of Sakra P.S. Case No. 581 of 2020 according to the law. (ii) For that respondents may be directed to
Patna High Court CR. WJC No.694 of 2022(3) dt.25-08-2022 2/3 submit chargesheet of Sakra P.S. Case No. 581 of 2020 within time framed.
(iii) For that the respondents may be directed to investigate the Sakra P.S. Case No. 581 of 2020 in fair and impartial manner.
(iv) For that the petitioner may be entitled in the facts and circumstances of this case." Learned counsel for the petitioner submits that the petitioner is looking for a fair and impartial investigation of the case. The grievance is that the police (I.O.) is sitting idle over the matter and even as the accused persons are veteran criminals having several criminal antecedents, no action is being taken in the matter.
It is submitted that the son of the informant is missing since 16.09.2020.
For the present, this writ application is being disposed of with a direction to the Senior Superintendent of Police, Muzaffarpur to personally supervise the matter, take steps towards proper investigation of the case, if necessary, change the I.O. and all efforts be made to trace the missing son of the petitioner. This Court expects that the Senior Superintendent of Police shall complete the investigation as early as possible within a reasonable time.
If the investigation does not progress and no
Patna High Court CR. WJC No.694 of 2022(3) dt.25-08-2022 3/3 significant action is taken by the Senior Superintendent of Police within a reasonable time, it will be open for the petitioner to approach this Court.
It goes without saying that the Senior Superintendent of Police, Muzaffapur will give chance of hearing to the petitioner on a date and time to be fixed by him. Let this order be communicated to the Senior Superintendent of Police, Muzaffarpur.
Certified copy of the order shall be made available only after removal of the defects.
