Petitioners apprehend arrest in a case registered for the offences punishable under Section 307 and other allied sections of the Indian Penal Code.
Prosecution case in short is that all the petitioners abused and assaulted the grand daughter and daughter in law of the informant by a rod as a result of which the daughter in
Patna High Court CR. MISC. No.34624 of 2019(2) dt.28-05-2019 2/2 law of the informant fell down on the ground. It is the contention of the petitioners that there is a case and counter case between the parties in which both sides sustained injuries. There is land dispute between the parties and the informant is the agnate of the petitioners. Petitioners have no criminal antecedent.
Considering the facts of the case, let all the petitioners, above named, in the event of arrest/surrender before the Court below within a period of six weeks from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Bhojpur at Ara in Udwant Nagar Police Station Case No. 477 of 2018, subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure as well as condition that the petitioners shall fully co-operate with the investigation and trial of the case, failing which the Court below shall be at liberty to cancel the bail bond of the petitioners.
