====================================================== CORAM: HONOURABLE MR. JUSTICE SUDHIR SINGH ORAL ORDER 30-06-2021 Heard learned counsel for the petitioner and the State through virtual mode.

The petitioner seeks bail in a case initially registered under Sections 398, 302 of the Indian Penal Code and 27 of the Arms Act.

Earlier prayer for bail of the petitioner was rejected vide Annexure-1 to the present application taking into account that it was a case of of dacoity-cum-murder and the petitioner was identified in CCTV footage.

A report was called for from the trial court. It has been reported that out of 15, three prosecution witnesses have already been examined. It has further been pointed out that it will take nine months' time to conclude the trial. Considering the nature of accusation and stage of the

Patna High Court CR. MISC. No.36515 of 2020(3) dt.30-06-2021 2/2 case, I am not inclined to grant bail to the petitioner. Accordingly, prayer for bail of the petitioner in connection with Hawai Adda P.S. Case No. 229 of 2017 is rejected. Learned trial court is directed to take all necessary steps to conclude the trial preferably within a period of nine months from the date of receipt/production of copy of this order.

The District Magistrate and the Sr. Superintendent of Police, Patna are directed to ensure the production of witnesses on the date fixed by the trial court so that the trial could be concluded within the stipulated period of nine months. Let a copy of this order be communicated to the District Magistrate and the Sr. Superintendent of Police, Patna for needful.
