JUSTICE SUDHIR SINGH ORAL ORDER 08-10-2018 Heard learned counsel for the petitioners and learned A.P.P. for the State.
The petitioners are apprehending their arrest in a case for the offence registered under Sections 147, 148, 149, 341, 323, 307, 353, 354(A) and 504 of the IPC.
The prosecution story, in brief, is that on 02.08.2017, one person of Nepura Village died due to electric shock with 11 K.V. wife and after the occurrence when Junior Engineer (Electricity), Lalita Kumari arrived at the place of occurrence at Kashichak all 25-30 unknown persons of Nepura Village
Patna High Court Cr.Misc. No.58368 of 2018 (2) dt.08-10-2018 2/2 committed assault with her and tried to kill and also teased her. It has been submitted by learned counsel for the petitioners that the petitioners have been made accused in the present case due to mistake of fact. The alleged occurrence is said to have taken place in protest against the Electricity Department where a person died due to electrocution. The petitioners are not named in the F.I.R. Their names have come in course of investigation. Allegation has been made against 25-30 unknown persons.
On behalf of the learned counsel for the State, it has been submitted that the petitioners are not named in the F.I.R. Considering the aforesaid facts and circumstances, let the petitioners above named, in the event of arrest or surrender before the learned court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned S.D.J.M. Nawada, in connection with Kashichak P.S. Case No. 62/2017 (G.R. No. 2167/2017), subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
