2. The petitioners have prayed for bail in connection with Habibpur P.S. Case No. 223 of 2025 registered for the offence punishable under Sections 318(4), 319(2), 338, 336(3), 340(2), 61(2), 111 of the B.N.S., 2023, Sections 65, 66C, 66D of the I.T. Act and Sections 9, 10 and 11 of the Public Examination Act.

3. The case of the prosecution, in short, is that the

Patna High Court CR. MISC. No.31629 of 2026(2) dt.12-05-2026 2/3 petitioners, who were working at Aang Institute, were apprehended by the police when the police had arrived there in search of one Karan Singh.

4. Learned counsel appearing on behalf of the petitioners has submitted that petitioners are innocent and have committed no offence. They have been falsely implicated in this case. He further submits that, from perusal of the FIR, it transpires that the petitioners are merely employees of Aang Institute, which is being run by one Sumit. It is further evident from the FIR that incriminating articles were recovered from the possession of Sumit. Learned counsel submits that the only allegation against the petitioners is that, while working at Aang Institute, they assisted prospective candidates by restarting their computer systems. It is further submitted that the nature of the allegations is general and omnibus. No incriminating article has been recovered from the possession of the petitioners. Moreover, a statement has been made in para 3 of the petition that petitioners have no criminal antecedent and they are languishing in judicial custody since 26.12.2025.

5. The application for bail is opposed by learned APP for the State.

6. Having heard learned counsel for the parties and

Patna High Court CR. MISC. No.31629 of 2026(2) dt.12-05-2026 3/3 considering the facts and circumstances of the case, this Court is inclined to enlarge the petitioners on bail. The above named petitioners are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) each with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Bhagalpur in connection with Habibpur P.S. Case No. 223 of 2025.
