JUSTICE ASHUTOSH KUMAR ORAL ORDER 12-12-2018 The petitioner seeks bail in anticipation of his arrest in connection with Salimpur P.S. Case No. 114 of 2018, dated 01.05.2018, instituted for the offences under Section 366A of the I.P.C.
The petitioner is alleged to have abducted the daughter of the informant.
The learned counsel for the petitioner has drawn the attention of this Court to the statement made by the victim girl under Section 164 Cr.P.C.
The statement referred to above, discloses that she (the victim girl) married the petitioner of her own volition
Patna High Court Cr.Misc. No.63895 of 2018(2) dt.12-12-2018 2/2 without any fear or favour from any quarter. In fact, it has been clearly stated in the aforesaid statement that on refusal of the petitioner to marry her, she threatened of committing suicide. The victim girl in her statement recorded under Section 164 Cr.P.C., has disclosed her age to be 18 years. The victim was also subjected to medical examination and there also, her age has been assessed at 18 years. Considering the aforesaid facts, the petitioner above named, in the event of his arrest or surrender before the learned Court below within a period of four weeks from the date of receipt/production of a copy of the present order, is directed to be released on bail on his furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Addl. Chief Judicial Magistrate-II, Barh, in connection with Salimpur P.S. Case No. 114 of 2018, subject to the conditions laid down under Section 438(2) of the Cr.P.C. (Ashutosh Kumar, J) Praveen-II/- U T
