2. The petitioner apprehends his arrest in connection with Indrapuri P.S. Case No.31 of 2024 instituted under Sections 126 (2), 115(2), 118(1), 74, 117(2)(3)(4), 109, 303(2), 352, 351(2), 3

(5) of the Bharatiya Nyaya Sanhita.

3. The allegation against the petitioner is that he along with co-accused Vivek Kumar assaulted Dhiraj Kumar with iron rod and the co-accused Vivek Kumar assaulted Dhiraj Kumar on his hand.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. He further submits that there is case and counter case between the parties. The injuries found on the injured are simple

Patna High Court CR. MISC. No.32931 of 2025(2) dt.20-05-2025 2/2 in nature except one injury found on the ring finger caused by co-accused Vivek Kumar. Petitioner has no criminal antecedent. Similarly situated co-accused Jimdar Singh has been granted anticipatory bail by a coordinate bench of this Court vide order dated 16.05.2025 passed in Cr.Misc.No.23315 of 2025. The petitioner undertakes to cooperate in the investigation and the trial.

5. Learned A.P.P. for the State opposes the prayer for anticipatory bail.

Considering the facts and circumstances of the case and submissions of learned counsel for the parties, in the event of arrest or surrender before the Court below within six weeks from today, the petitioner be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Dehri (Rohtas), District-Rohtas in connection with Indrapuri P.S. Case No.31 of 2024, subject to the conditions as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
