Petitioners are apprehending their arrest in connection with Daudnagar PS Case No. 218/2018 for the offence under Sections 341, 323, 307, 448 and 354/34 of the Indian Penal Code.
Learned counsel appearing for the petitioners seeks permission to withdraw the application on behalf of petitioner no. 2 Ranjan Ram.
In view of the above, application for anticipatory bail on behalf of petitioner no.2 is permitted to be withdrawn. The withdrawal of the case of petitioner no.2 will not cause prejudice in the event petitioner no.2 surrenders before the
Patna High Court Cr.Misc. No.62690 of 2018(2) dt.13-12-2018 2/2 concerned court below and prays for regular bail, the court below is directed to consider and allow the prayer for bail on the same day without being influenced by refusal of bail by this Court.
Considering the case of petitioner nos. 1 and 3 having no criminal antecedent against them and being ladies they deserve special treatment in the matter of grant of anticipatory bail. Accordingly, in the event of arrest or surrender before the court below within a period of one month from today, petitioner nos. 1 and 3 above named, are directed to be released on bail on furnishing bail bond of Rs.10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of the Sub Divisional Judicial Magistrate, Auragnabad in connection with Daudnagar PS Case No. 218/2018 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
