JUSTICE MOHIT KUMAR SHAH ORAL ORDER 17-03-2023 The present writ petition has been filed seeking the following relief :- "(a) For issuance of appropriate writ in the nature of mandamus commanding and directing the respondent authorities for permanent removal of encroachment from the land bearing Thana no. 138, Khata no. 322 and Kheshra no. 483 having Area 8 Katha, 13 Dhur and Thana no. 138, Khata no. 324 and Khesra no. 484 having Area 10 Katha, 05 Dhur and 10 Dhurki situated in the village-Simari, which comes under the police

Patna High Court CWJC No.22169 of 2013(6) dt.17-03-2023 2/2 station-Bakhari and Block-Bakhari of the District-Begusarai, as the same is a private land but the respondents have constructed the road over the same inspite of the protest of the petitioner."

After some arguments, the learned counsel for the petitioner seeks not to press the present writ petition, however, seeks liberty on behalf of the petitioner to avail such other alternative remedies, as are otherwise available under the law. Liberty so sought, is granted.
