The petitioner is apprehending his arrest in connection with Kachhawa P.S. Case No. 48 of 2019 for the offence registered under Sections 406, 409, 420, 468 and 120(B)/34 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner has falsely been implicated in the present case. It is further submitted that witnesses examined during investigation whose statement have been recorded in paragraph nos. 17 and 18 have categorically stated that no payment was made to the petitioner. They have stated that the beneficiaries have received

It is further submitted that similarly situated co-accused persons have been granted bail by a coordinate Bench of this Court vide order dated 19.06.2020 passed in Cr. Misc. No. 76668 of 2019. It is further submitted that the petitioner has no criminal antecedent.

Learned counsel for the State has opposes the application for grant of pre-arrest bail to the petitioner. Considering the facts and circumstances of the case, let the petitioner, above named, in the event of his arrest/surrender before the court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Bikramganj, Rohtas in connection with Kachhawa P.S. Case No. 48 of 2019, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
