====================================================== CORAM: HONOURABLE MR. JUSTICE ALOK KUMAR PANDEY ORAL ORDER 16-05-2025 Heard learned counsel for the petitioners and learned A.P.P. for the State.
2. The present petition has been filed for modification of order dated 08.10.2024 passed in Cr. Misc. No. 72705 of 2024.
3. Learned counsel for the petitioners submits that petitioners was granted bail on 08.10.2024 in Cr. Misc. No. 72705 of 2024 on furnishing bail bond of Rs. 10,000/- (Rupees Tenb Thousand) each with two sureties with certain conditions in which one of the conditions [condition no. (i)] is that one of
Patna High Court CR. MISC. No.33137 of 2025(2) dt.16-05-2025 2/3 the bailors shall be either father or mother or sister or brother or wife or person who has sworn the affidavit in bail application.

Learned counsel for the petitioners submits that despite the petitioners have been granted bail on 08.10.2024 but they have not released on bail up til now as they are not able to furnish bail bond of Rs. 10,000/- (Rupees Ten Thousand) as they are not economically well off. Accordingly, learned counsel prays for modification in condition no. (I) of bail order dated 08.10.2024 to this extent that one of the villagers of the said village where he is inhabitant may be permitted to stand as bailor so that petitioners could furnish bail bond. He further prays to reduce the sureties amount form Rs. 10,000/-(Rupees Ten Thousand) to Rs. 5,000/- (Rupees Five Thousand).
5. Learned APP does not controvert the aforesaid submission.
6. In the light of the aforesaid submission, condition no (i) of bail order dated 08.10.2024 passed in Cr. Misc No. 72705 of 2024 stands modified to the extent that one of the villagers of the said village where he is inhabitant be permitted to stand as bailor and the sureties amount is also reduced to Rs. 5,000/- (Rupees Five Thousand) from Rs. 10,000/- (Rupees Ten Thousand).

7. With the aforesaid observation, this modification petition stands disposed of.
