The petitioner is in jail custody since 07-03-2014 in a case reregistered under Section-392 of the Indian Penal Code. The petitioner is not named in the first information report but for the first time, his name came in this case on the basis of information, given to the I.O. by some agents of the bus stand, which is evident from perusal of paragraph-54 of the case diary and after that, some witnesses at paragraphs-63, 64 & 65 of the case diary, claimed to have seen the petitioner, committing the alleged crime. The above said witnesses, specifically, stated that the petitioner and his associate used Bolero vehicle for committing the alleged offence but in the first information report, the informant claimed that the miscreants had come on a Marshall
Patna High Court Cr.Misc. No.26571 of 2014 (3) dt.12-01-2015 2/2 Jeep.
It would appear from perusal of paragraph-3 to the petition that one case i.e. Delha P.S. Case No. 18 of 2009 under Section-302/34 of the Indian Penal Code was registered against the petitioner, prior to institution of the present case and except the aforesaid criminal antecedent; there is nothing against the petitioner.
Considering the above-said facts and circumstances as well as submission of the parties, let the petitioner namedabove, be released on bail on furnishing bail bond of Rs 10,000/- (ten thousand) with two sureties of the like amount each in connection with Chandauti P.S. Case No. 15 of 2009 to the satisfaction of Chief Judicial Magistrate, Gaya. (Hemant Kumar Srivastava, J) A.K.V./- U T
