JUSTICE MOHIT KUMAR SHAH ORAL ORDER 15-11-2019 The learned counsel for the petitioner submits that the short prayer in this writ petition is to restrict the respondent no. 4 from demolishing the house of the petitioner which has been constructed over part of R.S. Plot no. 207, Khata no. 59, Thana no. 144, Mauza-Mishripur, PS-Sasaram, District-Rohtas, admeasuring 05 decimals of land.

It is submitted by the learned counsel for the petitioner that the said house has been constructed under the Indira Awash Yojana Scheme but still the respondent no. 4 is adamant to demolish the same.

Having regard to the disputed question of facts involved in the present writ petition, I deem it fit and

Patna High Court CWJC No.7971 of 2017(3) dt.15-11-2019 2/2 appropriate to grant liberty to the petitioner to approach the District Magistrate, Rohtas at Sasaram by filing appropriate representation within a period of four weeks from today, whereupon the District Magistrate, Rohtas at Sasaram shall consider the same and pass a reasoned and speaking order within a period of eight weeks thereafter.

The present writ petition stands disposed off on the aforesaid terms.
